Privacy Statement

1. General

This Privacy Statement describes how Nicola Helmink NEI coaching and bodywork (Proprietorship) operating under name of Nicola Helmink (hereinafter the 'Coach') regulates and respects the privacy of the user of the website (hereinafter the 'User', plural the 'Users') and what information is collected about the User. This document also describes how the Coach collects, stores and uses data in the role of alternative/complementary care provider. If the user of the website uses the services of the Coach, the user of the website is referred to as the 'Client, plural the 'Clients'.

 

2. Permission request and privacy regulations

When using the Coach's website, this privacy statement is brought to the attention of every User and asked to agree to it. In addition, it is indicated that further use of the website means that you agree to the use of cookies and the current privacy statement. The Coach requests that the User first read these Privacy Regulations in their entirety before using this website and, if they do not agree with these Privacy Regulations, not to use the website and to leave immediately.

3. Nature of information to be retained 

Now and in the future, the Coach collects information about the Users of this website. The Coach uses the website for the purposes stated below.

3.1 If the Coach's website uses an online store or other way in which products/services can be purchased.

For orders via the website, personal data is stored such as name, address, age (age to test legal capacity - legitimate interest), gender, e-mail address and telephone number.

3.2 If the Coach's website has a way to request information (newsletter, or other information) or shares information with the User

To request information via the website, personal data such as name, address, age (age to test legal capacity - legitimate interest), gender, email address and telephone number are stored.

3.3 If the Coach's website has a way for the User to register or register for alternative care or if the website advertises or calls for this. (User becomes Client).

The Coach collects more data from a Client than from a standard user. The Coach is actually obliged to maintain an extensive client file for each Client. See article 3.4 for this.

3.4 The Coach keeps a file on each Client

I work with Carepatron, a professional file and administration system in the cloud. The supplier is also subject to strict GDPR requirements. I do my best to guarantee your privacy.

This file contains the following types of data about the Client: name, address, age (age to test legal capacity - legitimate interest), gender, e-mail address, telephone number, medical data, notes about the (mental) health status of the Client, and data about the coaching carried out by the Coach regarding the Client and the frequency with which the Client receives care from the Coach. In short, the Coach documents who receives, which care and when each time the Client receives care. The treatment agreement is also included in the client file. It is possible that the Coach, with the Client's express permission, requests or shares medical data from a fellow healthcare provider or from a general practitioner. Such data will also be included in the file.

3.5 E-mail messages

If e-mail messages are sent, this e-mail and/or associated information from the e-mail may be stored in connection with the purpose for which these e-mail messages serve.

4. Purpose of storing information

 4.1 Administration

The information is used for various purposes. Retained information (retention period is 7 years) as stated in Articles 3.1 and 3.3 is used to process and charge orders and deliveries thereof or, if applicable, alternative care in accordance with the contract, for accounting and the handling of any disputes. Information from Article 3.3 or 3.5 can also be kept for this purpose.

4.2 Improvement of services

Collected information referred to in articles 3.2, 3.3 and 3.5 and possibly 3.1 is used to improve the website and optimize user-friendliness of our website.

4.3 Marketing

Collected information as mentioned in point 3 (with the exception of point 3.4) can also be used to point users to information of interest to them. Collected data (again with the exception of data from point 3.4) is used to develop new products and services. This concerns information that is provided by the user to the Coach during a visit to our website or via other means.

 

This data can be used for marketing purposes and as anonymised statistical information for customers and business partners.

Privacy-sensitive data, such as credit card information, is treated confidentially and not made available to third parties. In order to optimise the quality of products and services, the Coach records the use of support services for products, as well as defects or complaints regarding the products. This may include serial numbers and information about the purchase, such as the date of purchase. A user may be asked to provide information about themselves for the purpose of delivering or returning products. Personal data will only be used for commercial purposes if a user is a customer (GDPR basis: execution of agreement and/or legitimate interest) or if unambiguous permission has been given in advance in accordance with the GDPR.

4.4 The client file

The Coach is legally obliged to keep a file on each Client in a designated client file. The Coach uses Carepatron such as described in 3.4. The data in this file will be kept for 20 years. The data in the file is used to provide effective care. The information can be used for various other purposes: (i) Financial Administration – For example, to draw up an invoice. (ii) Anonymous discussion during peer supervision - The Coach can have peer supervision with a fellow coach and then discuss the Client's case. This is anonymised; no information that can be traced back to a person is discussed. (iii) Informing other healthcare providers – When the Coach is absent and another coach deputises or when referring to another coach (only with the Client's consent).  (iiii) If the client file is shared for any other purpose, this will be done with the Client's consent.

4.5 Information on the care invoice

The Client will receive an invoice if care has been provided by the Coach. In practice, this means that this is later sent by e-mail. This invoice contains the following information about the Client: Name, Address, Place of Residence, Date of Birth, Costs of the consultation, description of the type of care provided, date of the treatment. This information is for the Client's administration and, if the coach's consultations are eligible for reimbursement from a health insurance company, may be submitted to the reimbursing health insurance company.

5. Changes to the Privacy Policy

In the future, the way in which information is used or deployed and the purposes for which this is done may change. In that case, the Coach will mention the changes in a revised Privacy Policy and post them on the website. Users who do not agree to a revision of the Privacy Regulations can send their objection to the correspondence address or email address below as stated in Article 9. The Coach will respect and take into account the objections. If no objections are submitted, the visitor is deemed to agree to the changes when using the website.

 

6. Changes to data or questions about privacy

If the User or the Client wishes to change or delete the information stored by the Coach or if the User or the Client believes that the information is being used for a purpose other than that for which it was provided, the User or the Client must report this to the Coach by post or e-mail as stated in Article 9. The Coach will then ensure that the data is adjusted or deleted, with the exception of the information that is required by law or is directly related to a concluded agreement such as the storage of data. the information is necessary for this.

7. Safety

The Coach uses standard technologies to guarantee security as much as possible and to prevent unauthorised access as much as possible. However, this cannot be guaranteed with complete certainty. The Coach is not liable for unauthorised use of the information referred to in Article 3 or access to the website. The Coach recommends changing passwords regularly and working with a reliable and secure browser.

 

8. Website user address

Users and Clients are obliged to inform the Coach of changes of address and changes to other contact details. As long as the Coach does not receive a notice of move or change of other contact details, the last details known to the Coach will be assumed to be the correct details. Any resulting miscommunication or incorrect delivery is at the expense and risk of the User or Client. As long as a new address has not been provided, it remains liable for products ordered by the User or Client that are delivered to the old address.

10. Additional information

10.1 Complaints regarding the handling of the User’s or Client’s personal information, may be made to the Office of the Privacy Commissioner (www.privacy.org.nz).

10.2 If the User or the Client shares a photo or other image as part of the information referred to in Article 3, this photo or image will also be stored as information as stated in Article 4.

10.3 If the Client or User also uses a program or software for sharing information without interference from the Coach, it is possible that this program or software shares, distributes, etc. the information independently and without interference from the Coach. The Coach cannot guarantee the way in which the program or software handles information in a situation described in this article 10.3.

10.4 If the Coach uses the services of a third party that acts as a processor of information as described in Article 3, the Coach has concluded a Processing Agreement with this party.
